Abstract

The question of the judicial process of adoption of children by homosexual couples runs through several social issues. It involves legal and cultural aspects, which go beyond the symbolic limits, and that deal with legal and ethnic issues, involving questions and confrontations. There are, explicitly or implicitly, ethnic boundaries that mark the place of each subject in society, specifically, by involving sexuality, homosexuality, "new" family concepts, social, religious, philosophical and legal questions about the issue . The "new" family arrangements, put to the ethnicity, the society, by reason of diverse transformations, reorganizes and recreates the family. Thus, the present study investigated how and to what extent the ethnic and socio-sexual markers of homosexual couples interfere, influence or rely on the judicial decisions for the adoption of children in Jequié, Ilhéus and Vitória da Conquista, in the State of Bahia, having as collaborators judges who accompanied the aforementioned applications for adoption and the couples who intended to carry out the adoption of children. Thinking about how discourses work is to place oneself at the crossroads of a double play of memory: that of the institutional memory that stabilizes, crystallizes, and at the same time, that of the memory constituted by forgetfulness that is what makes the different, the rupture possible , the other. With the analysis of sociological data of the groups involved, the research presented some ethnic and socio-sexual markers of homosexual couples as possible reasons of the judicial decisions for the adoption of children by the gay couples.
